The former CEO stated that he managed the company for more than 8.5 years, there were no complaints about him, the contract was extended regularly – every two years since 2015. During his work, Lapshin regularly indexed the wages of employees, he assured the court.
“But when I raised the issue of indexing my own salary, a company member showed me the door,” he said.
The plaintiff cited a conflict situation and “the desire to get rid of the employee” as the true reason for his dismissal. And MOL-Russ told the court that “trust in the CEO was undermined after the announcement of a huge, unfounded monetary demand and avoidance of participation in constructive negotiations.”
In particular, we are talking about salary indexation – the plaintiff filed two lawsuits with the court: for reinstatement in the position and for recovery of salary “taking into account the illegally not conducted indexation”. He demanded to pay him more than 40 million rubles, not counting 50 thousand rubles in compensation for moral damages for both lawsuits.
He recalled the industry tariff agreement concluded in 2018 for organizations in the oil refining industry and the oil product supply system of Russia. It regulates mandatory annual indexation for this sector, and its term ends in 2024.
The court did not agree with Lapshin’s arguments and denied the claims.
