Parliamentarian Fatima Al-Tamani said that some higher education institutions not affiliated with the university are witnessing violations regarding appointments to senior positions, referring to what happened at the Higher Institute for Audiovisual and Cinema Professions.

Al-Tamani stated in a written question addressed to the Minister of Youth, Culture and Communication, that appointments to the positions of directors of higher education institutions not affiliated with the university are considered senior positions that are deliberated upon by the Government Council, in accordance with Chapter 92 of the Constitution and Regulatory Law No. 12-02 related to appointments to senior positions. In application of the provisions of Chapters 49 and 92 of the Constitution.

She added that, unfortunately, some higher education institutions not affiliated with the university are witnessing violations in the application of this chapter of the constitution, as happened at the Higher Institute for Audiovisual and Cinema Professions, where a new director of the institute was appointed since September 2023, without the appointment being made with the approval of the Government Council.

Al-Tamani indicated that this appointment contradicts the contents of Chapter 92 of the Constitution and Organic Law 02-12, which stipulate the principle of equal opportunities, entitlement, transparency and equality as criteria for appointment to these positions, as well as the complete absence of the institute development project stipulated in Law 01-00, which It constitutes a complete violation of the principle of good governance and linking responsibility to accountability.

Accordingly, the representative asked about the corrective procedures and measures that the guardian ministry will take to ensure respect for the principles of the constitution and regulatory laws in the appointment processes in its higher education institutions, as well as about the solutions proposed to correct the situation in the aforementioned institute and who will bear responsibility for ensuring the rights of students, administrators and research professors.
