The traffic police explained how not to lose your license when overtaking several cars

Traffic rules that establish the conditions under which an overtaking maneuver is prohibited cause dissatisfaction among a significant number of drivers due to the vagueness of the wording. njcar portal. ru received information from a traffic police representative about cases when a driver can lose his license for overtaking several cars.

According to paragraph 11.2 of the Traffic Rules, the driver is prohibited from performing an overtaking maneuver if the vehicle moving ahead is overtaking or going around an obstacle.

Previously, this provision was interpreted by traffic police officers and courts as follows: until the car in front has completed the overtaking maneuver, the following vehicle is not allowed to cross into the oncoming lane. This offense, according to Part 4 of Article 12.15 of the Code of Administrative Offenses of the Russian Federation, may entail a fine of 5,000 rubles or deprivation of rights for a period of 4 to 6 months.

However, according to paragraph 15 of the resolution of the Plenum of the Supreme Court dated June 25, 2019 “On some issues arising in judicial practice when considering cases of administrative offenses provided for in Chapter 12 of the Code of Administrative Offenses,” the interpretation of this violation took a different form.

Court decisions have determined that it is only prohibited to overtake a vehicle in front. That is, performing an overtaking maneuver is prohibited only in relation to a specific vehicle that is currently overtaking or avoiding an obstacle.
